Terms of Use

1. Contracting Parties

This Term of Use is entered into between GalilAI Inteligência Artificial LTDA, CNPJ: 14.756.788.0001-75, headquartered at Avenida Professor Osmar Cunha, 416, Sala 1108, Florianópolis, Santa Catarina (“GalilAI”, “We”, or “Company”), and you, user of the GalilAI platform (“User”).

2. Acceptance of the Term

By accessing or using the GalilAI platform, the User declares to have read, understood and agreed to the terms described herein. If the User does not agree with the Terms of Use, he/she must refrain from using the platform.

3. Purpose

The GalilAI platform is a Software as a Service (SaaS) based on Artificial Intelligence that allows the creation, design and publication of posts for social networks in an automated manner.

4. Plans and Payments

4.1. Payment must be made annually or monthly, according to the instructions provided by the Company at the time of contracting.

4.2. In the event of default, access to the platform may be suspended until payment is regularized.

5. User Obligations

5.1. The User undertakes to:

- Use the platform exclusively for purposes permitted by law;

- Provide true and complete information when registering;

- Maintain the confidentiality of their access credentials.

5.2. Use of the platform for illicit or fraudulent purposes or for purposes that infringe the rights of third parties is prohibited.

6. License to Use

6.1. GalilAI grants the User a limited, revocable, non-exclusive and non-transferable license to use the platform, in accordance with the terms of this Agreement.

6.2. The User is prohibited from:

- Reproducing, modifying or distributing GalilAI software without prior authorization;

- Reverse engineering or any attempt to access the platform's source code.

7. Limitation of Liability

7.1. GalilAI shall not be liable for:

- Losses or damages resulting from improper use of the platform;

- Technical problems, such as internet connection failures;

- Unforeseen results resulting from the application of suggestions generated by artificial intelligence.

7.2. The User is solely responsible for the content published on their social networks.

8. Privacy and Data Protection

8.1. Commitment to Privacy

GalilAI is committed to protecting the privacy and security of Users' information, in accordance with the LGPD.

8.2. Data Collected

- Data provided by the User at the time of registration;

- Platform usage data;

- Technical information, such as IP and operating system.

8.3. Purpose of Data Processing

The data is used to:

- Provide access and personalize services;

- Process payments;

- Improve platform features.

8.4. Data Sharing

GalilAI does not share personal data, except in cases required by law or with service providers.

8.5. Information Security

GalilAI uses technical and organizational measures to protect User data.

8.6. User Rights

- Confirm the existence of the processing of your data;

- Access, correct or request the deletion of your data.

8.7. Data Storage and Retention

The data will be stored for as long as necessary or to comply with legal obligations.

8.8. Cookies and Similar Technologies

GalilAI uses cookies to improve the User experience.

8.9. Changes to the Privacy Policy

This Policy may be updated periodically.

9. Termination and Cancellation

9.1. The User may cancel the subscription at any time

9.2. The User may request a refund by contacting support via email at suporte@galil.ai.

9.3. For monthly plans, GalilAI will refund the amount corresponding to the last installment paid.

9.4. For annual plans, the refund is calculated based on the proportional monthly amount. Since the annual plan has a 40% discount, the equivalent monthly amount will be recalculated. The refund will correspond to the difference between the total amount paid and the cost of the months already used by the User without the annual discount.

Example: If the User requests a refund after 6 months, the full monthly amount multiplied by 6 will be considered. The difference between this amount and the amount paid for the annual subscription will be the amount to be refunded.

9.5. GalilAI reserves the right to terminate the User's access in the event of a violation of the Terms of Use.

10. Changes to the Terms

GalilAI may update these Terms at any time. Continued use of the platform will be considered as acceptance of the new conditions.

11. Legislation and Jurisdiction

These Terms will be governed by Brazilian laws. The jurisdiction of the district of Florianópolis, Santa Catarina, is elected to settle any disputes related to these Terms.
